Welcome to customAi Business Solutions LLC (“Company”, “we”, “us”, or “our”). This Acceptable Use Policy (“AUP”) outlines the rules and legal boundaries governing the use of our AI software development services, custom automation workflows, voice receptionists, data extraction tools, and any custom applications or integrations we build or deploy (collectively, the “Services”).

By utilizing our Services, contracting our automation development, or interacting with our deployed systems, you (“Client”, “User”) agree to strictly comply with this Policy.


1. Prohibited Deceptive & Harmful Content

You agree not to use our custom AI workflows, voice agents, or software integrations to generate, process, or transmit any content that is:

  • Deceptive or Fraudulent: Creating political deepfakes, non-consensual voice clones, or synthetic media designed to intentionally mislead, defraud, or impersonate individuals or corporate entities.

  • Malicious or Destructive: Utilizing automations to distribute malware, phishing links, or coordinates for cyberattacks.

  • Harassing or Defamatory: Generating automated hate speech, targeted harassment, or explicit/adult content that violates local, state, or federal laws.

2. Automated Telephony & Voice Agent Compliance (TCPA)

If your custom AI solution utilizes automated voice receptionists, outbound calling, or SMS text automation (including systems built via Vapi, Retell, or associated telecommunication APIs):

  • Express Consent: You are strictly prohibited from using our systems to place unsolicited marketing calls or texts. You warrant that you have obtained explicit, verifiable prior express written consent from any recipient in strict accordance with the Telephone Consumer Protection Act (TCPA) and international telemarketing laws.

  • Robocall Restrictions: You may not use our voice agents for mass-scale, automated voice spamming, robocalling, or deceptive caller-ID spoofing.

  • Indemnification: The Client assumes 100% legal liability for the operational deployment of voice automation and agrees to indemnify customAi Business Solutions LLC against any regulatory fines, lawsuits, or penalties resulting from non-compliant calling or messaging practices.

3. Data Scraping & Extraction Limits

If your custom automation involves data extraction, lead generation, or web scraping workflows (including systems utilizing Apify or custom regex scripts):

  • Platform Terms: You agree not to deploy our scraping solutions in a manner that intentionally breaches the target platform’s robots.txt files, crashes external servers, or violates the explicit Terms of Service of third-party platforms (such as Google Maps, public directories, or enterprise databases).

  • Personal Data: You are solely responsible for ensuring that any scraped contact information (e.g., email addresses or phone numbers of professionals) is stored and utilized in accordance with local privacy laws (including CAN-SPAM and CCPA).

4. Third-Party AI Engine Dependency & Data Routing

Our custom automation workflows act as an architectural bridge between your operations and third-party artificial intelligence engines (including, but not limited to, OpenAI, Anthropic, and associated LLM providers).

  • Data Processing: By using our Services, you acknowledge and agree that your data will be routed through these third-party APIs.

  • API Policy Adherence: You must comply with the Acceptable Use Policies of those underlying AI providers. You may not use our workflows to bypass the safety filters, prompt-inject, or reverse-engineer the core models of our third-party vendors.

5. Limitation of Liability for AI Output & Workflows

  • No Liability for “Hallucinations” or Errors: Artificial Intelligence models can generate inaccurate information, code errors, or contextual “hallucinations.” customAi Business Solutions LLC is not legally or financially liable for any business disruptions, inaccurate booking schedules, flawed data extractions, or financial losses caused by an incorrect output generated by an AI model or a temporary webhook/API downtime.

  • Operational Monitoring: The Client retains ultimate responsibility for monitoring, auditing, and supervising the outputs of their automated systems and AI receptionists before relying on them for critical business decisions or consumer interactions.

6. Intellectual Property & Code Ownership

Unless explicitly modified in a signed Master Services Agreement (MSA) between the parties:

  • Underlying Architecture: customAi Business Solutions LLC retains all intellectual property rights, structural templates, proprietary script integrations, and architectural logic developed during the creation of your automation workflows.

  • Client Data & Prompts: The Client retains ownership of their proprietary business inputs, custom data layers, and finalized output generated by the operational workflow.

7. Enforcement and Termination

We reserve the right, at our sole discretion, to suspend, terminate, or restrict access to our custom software services or disconnect active automation endpoints immediately and without notice if a Client or User is found to be in violation of any terms outlined in this AUP.
